Terms of Service

These Terms of Service ("Terms") govern your access to and use of Forge Anesthesia, operated by Forge Anesthesia LLC ("we," "us," or "our"). By creating an account or making a purchase, you agree to be bound by these Terms.

1. Use of the Platform

Forge Anesthesia is an exam preparation platform for Student Registered Nurse Anesthetists (SRNAs) preparing for the NBCRNA National Certification Exam (NCE). The platform provides adaptive mock exams and performance analytics.

Eligibility

You must be at least 18 years old to create an account. By using this platform, you represent that you are accessing it for legitimate educational purposes.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share your account with others or allow others to access exams purchased for your account.

2. Purchases & Refunds

Exam Access

Upon purchase, you receive access to the number of adaptive mock exams specified in your plan. Some promotional codes (such as KUBETA) may grant unlimited attempts. Standard purchases allow one attempt per exam slot.

Refund Policy

Because exam content is delivered digitally and immediately upon purchase, all sales are final. We do not offer refunds once an exam has been started. If you experience a technical error that prevents you from completing an exam, contact us at forgeanesthesia@gmail.com within 7 days and we will review your case.

Pricing

All prices are listed in USD. We reserve the right to change pricing at any time, but changes will not affect purchases already made.

3. Content & Intellectual Property

All exam questions, rationales, scoring algorithms, and platform content are the exclusive property of Forge Anesthesia LLC. You may not reproduce, distribute, share, screenshot, or transmit any exam content in any form — including posting questions or answer choices in study groups, forums, or social media.

Violation of this section may result in immediate account termination without refund and may expose you to legal liability.

4. Prohibited Conduct

You agree not to:

• Share exam questions, answer choices, or rationales with any third party
• Use automated tools, bots, or scripts to interact with the platform
• Attempt to reverse-engineer the adaptive algorithm or scoring system
• Create multiple accounts to circumvent exam attempt limits
• Use the platform in any way that violates applicable law

5. Disclaimers & Limitation of Liability

Forge Anesthesia is an educational preparation tool and is not affiliated with, endorsed by, or sponsored by the NBCRNA. Passing a Forge mock exam does not guarantee passing the actual NCE.

The platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Forge Anesthesia LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

Our total liability to you for any claims arising out of these Terms shall not exceed the amount you paid for your plan.

6. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, without notice and without refund. You may request account deletion at any time by contacting us.

These Terms are governed by the laws of the State of Kansas. Any disputes shall be resolved in the courts of Kansas.

Privacy Policy

Forge Anesthesia LLC ("we," "us," or "our") is committed to protecting your personal information. This Privacy Policy explains what data we collect, how we use it, and your rights regarding that data.

7. What We Collect

Account Information

When you create an account, we collect your email address and any profile information you provide.

Purchase Information

Payment processing is handled by Stripe. We do not store your credit card details. We receive confirmation of your purchase including the plan purchased and your email address.

Exam Data

We collect data generated during your use of the platform including:

• Your answers to exam questions and whether they were correct
• Time spent per question and per exam
• Your program year (1st, 2nd, or 3rd year SRNA) if provided
• Device type and browser used to take exams
• Performance metrics including score, domain breakdown, and ability estimates

Usage Data

We collect standard usage information including pages visited, features used, and interactions with the platform.

8. How We Use Your Data

We use your data to:

• Deliver and improve the exam preparation service
• Provide your personal performance analytics and results history
• Improve question quality and the adaptive algorithm using aggregated, de-identified exam data
• Send transactional emails (purchase confirmation, exam results, account-related notices)
• Generate cohort benchmarks — aggregate comparisons by program year shown on results pages. No individual data is ever exposed to other users.

We do not sell your personal data. We do not use your data for advertising.

9. Data Sharing

We share your data only with the following service providers, strictly for operating the platform:

• Supabase — database and authentication hosting
• Stripe — payment processing
• Resend — transactional email delivery
• GitHub Pages — website hosting

We may disclose your information if required by law or to protect the rights and safety of our users or the public.

10. Data Retention

We retain your account and exam data for as long as your account is active. Exam results and performance data are retained indefinitely to support your personal history and our platform improvement efforts. If you request account deletion, we will delete your personal data within 30 days, except where retention is required by law.

11. Your Rights

You have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your account and associated data
• Opt out of non-essential communications
